Massachusetts Auto Auctions Terms and Conditions:
All users certify that they are at least 18 years of age to register, use, sign up, bid and or list Items for sale on this site.
Bidding on an item indicates your intent to purchase that
item and is considered a legally binding contract between yourself and the
seller of the item. Bids cannot be canceled once they are submitted. Upon
receiving notification that you are the winning bidder you are obligated to
purchase the item and pay the buyer's final sale fee and any applicable sales taxes. If you are tax exempt please contact us and we will send you an exempt form to be filled out.
All auctions are subject to the terms and conditions of the
seller and massautoauction.com massautoauction.com reserves the right to reject
any and all bids for any reason. The high bidder is the bidder with the highest
bid at the close of the auction on all non-reserve auctions and any auctions
that have met the reserve at the close of the sale.
FAILURE TO HONOR YOUR WINNING BID MAY BE CONSIDERED FRAUD
AND WILL BE PROSECUTED TO THE FULL EXTENT OF THE LAW. YOU MAY ALSO FACE CIVIL
ACTION BY THE SELLER AND/OR MASSACHUSETTS AUTO AUCTIONS, CHRISTOPHER W. LENOX

ALL SALES ARE FINAL. You are legally obligated to pay for
your item per the terms of the seller/massautoauctions if you are the high
bidder at the close of any auction. If you do not pay for your item, you will
not receive a refund of your buyer's final sale fee or any other already paid
fees. You will no longer be permitted to bid on massauctoauction.com and will
be subject to a penalty of 20% of the winning bid amount.
All payments will be processed thru Pay-Pal or by certified
bank check, wire transfers.
DENIAL OF SERVICE: Massachusetts Auto Auctions reserves the
right to refuse service to anyone for any reason.
TERMS OF SERVICE:
This comprises the entire agreement between the Seller /
Bidder and massautoauction.com and supersedes all other agreements. By
registering and participating as a user you are indicating your consent to be
bound by this agreement.

EXCEPT AS SPECIFIED HEREIN, THE SERVICES ON THIS WEBSITE ARE
PROVIDED SOLELY ON AN "AS IS" BASIS. MASSAUCTOAUCTION.COM HEREBY DISCLAIMS
ALL EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTEES, AND CONDITIONS,

QUALITY, SUITABILITY, ACCURACY, OR COMPLETENESS OF ANY OF THE PRODUCTS/SERVICES

HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. YOU AGREE TO
HOLD SITE OWNER/AUCTIONEER HARMLESS FROM, AND YOU COVENANT NOT TO TAKE ANY
LEGAL OR OTHER ACTION AGAINST SITE OWNER, ASSERTING ANY CLAIMS BASED ON OR
RELATED TO THE USE OF THIS WEBSITE.
GENERAL USE:
This site is provided only as a venue for bidders and
auction posters. Massautoauction.com is not involved in the actual transaction
between these parties and assumes no control or liability over any issues that
may arise as a result of this transaction. Sellers agree not to list items
listed on this website for sale in any other location. Bidders and Sellers
shall not engage in activities intended to avoid massautoauction.com fees.
All materials provided on the Website, including but not
limited to information, documents, products, logos, graphics, images, auctions,
and services are the wholly owned and copyrighted work of massautoauction.com
and/or its Third Party Providers. None of the materials posted herein may be
copied, reproduced, distributed, republished, downloaded, displayed, posted or
transmitted in any form. Including but not limited to electronic, mechanical,
photocopying, recording, or other means.
To register on this site you must provide your true name and
a valid email address, contact information. You must be the true owner of any
listed items or have legal authorization/contract to sell, dispose of such
property.
By listing an item on the site you agree to list item as honestly
as you can in regard to condition, problems that are known, and any valid
merchandise warranty/guarantee that may be applicable in the state of
residence, location of item sold. This shall cover any used vehicle warranty
laws in said state at time of sale. Failure to be honest and or not honor any
state laws regarding applicable warranty/guarantee laws may result in civil
action by the purchaser and or Massachusetts Auto Auctions.
PLEASE NOTE ONCE AGAIN : All auctions are subject to the
terms and conditions of the seller and massautoauction.com Massachusetts Auto Auctions reserves the right to reject any and all bids for any
reason, accept or reject any registered bidder for any reason, and accept or
reject any items listed for auction at any time.
Seller’s fees:
Upon your approval your account will be credited as new
registration with $10.00 (not refundable, only to be used for listing fees)
There is no fee to be a member, however there are small listing fees as well as
some fees for extra pictures, videos etc. There is a 5% seller’s fee when an
item is sold. If it doesn’t sell there’s no sellers fee other than the listing
or extra fees that were initially charged. The listings can renew 2 times
after if not sold. We collect all
payments from buyers via Pay Pal, wire transfer or certified check, we collect
all sales tax. You will receive payment due minus sellers fee and sales tax
after payment within 15-30 days (having multiple auction listings may make this
time frame due to waiting for all to close or be paid) Payments to sellers will
be by Pay Pal or company check mailed directly.
For government agencies, municipalities there are no seller’s
fees, no listing fees. All payments will be done the same unless requested.

Buyers fees:
We charge a 10% buyers fee on won lots. All payments will be
invoiced by us thru Either Pay-Pal (You can pay with credit card, no acct up to
$1000.00) Money order, certified bank check or on larger purchases over
$1000.00 You can pay with a bank wire transfer. To pay with Pay-Pal on items
over $1000.00 the buyer’s fee will be 14%. Payments will be due within 5 days of end of auction.
We offer complete listing service where we will come and
take the pictures, organize items into lots, set up the listings and the whole
auction. We can do whole house estate auctions, The fee schedule will be

Classified ads:
Classified ads created by owners of items for sale in ads will collect payment and any sales tax due themselves. There will be no arbitration thru us ( Massautoauction.com) Any problems regarding items listed in classified ads will be between the listing seller and the purchaser.
